Pending Legislation
This blog post will outline some of the legislation affecting common interest subdivisions that has been submitted to the legislature for consideration. AB 1360 would allow associations to utilize electronic balloting instead of the costly double-envelope mail-in system. Another election bill, AB 968 is designed to help small associations of no more than 6 units. It allows elections to be conducted at meetings without the mail-in ballot process. A bill prohibiting smoking in individual units is proposed in AB 746. AB 637 is an attempt to clarify maintenance responsibility of owners for exclusive use areas, such as patios, balconies, parking spaces, etc., that are appurtenant to their units. This bill would only require the owner to maintain the area but not be responsible for repairing or replacing it.
